Problems with the Clearinghouse? Here’s what you should do

A high volume of users has created a bumpy start to the FMCSA’s CDL Drug and Alcohol Clearinghouse website. Due to capacity issues, many Clearinghouse users trying to register, query, upload, or find information have experienced error messages or delays with the database’s functionality. FMCSA is working to resolve these issues as quickly as possible.
In the meantime, FMCSA has stated that employers “should continue to proceed with the ‘normal’ hiring process pre-Clearinghouse until the FMCSA notifies the public to the contrary. The FMCSA will not penalize or otherwise hold carriers and drivers accountable for the technical failures.” In support of that statement, the agency issued the following notice regarding the hiring process while users are unable to access the Clearinghouse:
“The clearinghouse is currently experiencing some intermittent technical issues. If you are an employer currently experiencing technical difficulties accessing the Clearinghouse and are unable to conduct required pre-employment queries, you may hire a driver using solely the procedures set forth in 49 CFR 391.23(e). Once FMCSA has determined and announced that users are able to access the Clearinghouse, pre-employment queries must also be conducted as required by section 382.701(a).”
ATA recommends employers currently experiencing technical difficulties to document those difficulties.
